He currently serves as the managing partner and attorney at Fabricant LLP, a role he has held since 2020. In this capacity, he manages client relationships and handles patent litigation matters, litigating against major companies such as Google, Apple, Facebook, and Microsoft. He oversees the day-to-day operations of the firm and manages a team of 15 attorneys and non-attorney staff, including paralegals and secretaries. His experience also includes serving as partner and chair of intellectual property litigation at Brown Rudnick LLP from 2014 to 2020 and at Winston & Strawn LLP from 2011 to 2014. Prior to that, he was a partner at Dickstein Shapiro LLP from 2005 to 2011, partner at Ostrolenk Faber LLP from 2000 to 2005, managing partner at Fabricant & Yeskoo LLP from 1987 to 2000, and attorney at Shea & Gould from 1980 to 1987.

Mr. Fabricant holds memberships with the New York City Bar Association, the American Bar Association, the Arizona State Bar Association, and the New York Bar Association. He is also an active supporter of the Jay Heritage Foundation and a fundraiser for various projects with the University of Illinois Chicago Alumni Foundation. Laying a solid educational foundation, he earned a Bachelor of Arts in political science, magna cum laude, from the University of Miami in 1975, and a Juris Doctor, summa cum laude, from the University of Illinois Chicago School of Law in 1978. He holds bar credentials from New York, Arizona, the United States Supreme Court, and numerous district and federal courts of appeal. In light of his impressive undertakings, he has been named to the IAM Strategy 300, recognized as a Top Rated Intellectual Property Litigation Attorney by Super Lawyers, and awarded an AV Preeminent Rating by Martindale-Hubbell.

Reflecting on his career, Mr. Fabricant has primarily served as a trial attorney, consistently taking the lead in every trial, particularly in jury trials related to patent cases. He has achieved notable successes, including winning jury verdicts on the plaintiff’s side in patent infringement cases against Amazon, and securing successful defense verdicts in patent infringement cases as a defendant. One of his most significant cases involved successfully defending a major client sued by McKesson, an international medical supply company, against patent infringement claims. In another major case against Amazon, his team proved patent infringement. Over the past 15 years, he has handled over 810 patent cases, building a wealth of experience and a strong reputation in this field.

Mr. Fabricant attributes his success to understanding the importance of being highly responsive to his clients’ needs. He knows that quick replies and demonstrating his availability are essential to building trust, and emphasizes the critical role of providing personal, quality service and ensuring that each client feels important. In the coming years, he aims to enhance the reputation of his firm, preferring to maintain a smaller size to preserve the unique, personalized environment while still attracting the highest quality of talent. He advises those in the legal field not to be discouraged by a lack of engineering expertise when handling technology cases. He believes that, whether dealing with construction lawsuits or patent disputes, there is always a story to be told, and it needs to be communicated in a clear and straightforward manner. Even if a case involves complex engineering, it should be explained in a way that judges and juries without technical backgrounds can easily understand.
