With nearly five decades of experience to his credit, Mr. Burke has built a successful career in legal services, specializing in mediation, arbitration, and business disputes, particularly in real estate and technology. He currently serves as an independent mediator and arbitrator with Frank Burke Mediation and Arbitration PC, a role he has held since 2022. In this capacity, he is part of mediation panels for five counties: the Federal Court Bar, the San Francisco Bar Association, and the Santa Clara County Bar Association. His work includes speaking engagements, writing, mediating cases, and arbitration. Additionally, he founded Frank Burke Mediation and Arbitration PC, leading it from 2017 to 2022, and served as a mediator and arbitrator for ADR Services Inc. during the same period. He held partnerships at Foley & Lardner LLP from 2014 to 2017, Seyfarth Shaw LLP from 2012 to 2014, Steptoe & Johnson LLP from 1994 to 2012, and Streich Lang from 1985 to 1993. Earlier in his career, he was an assistant United States attorney with the Department of Justice from 1980 to 1985, an associate attorney at Morrison & Foerster LLP from 1977 to 1980, and Sherman & Howard from 1975 to 1977.
Mr. Burke has also contributed as a co-editor of “The Corporate Litigator” for the American Bar Association and authored a featured article for the Daily Journal of Los Angeles. He has written for various publications, including Law360, The American Lawyer, The Practical Litigator, Daily Journal, California Lawyer, The Recorder, and Westlaw. Additionally, he has been a speaker at over 100 presentations, webinars, and conferences. He has also been a mediator and arbitrator with the American Arbitration Association since 2017, a member of the Mission Bay Yacht Club in San Diego since 1989, an academy member of the National Academy of Distinguished Neutrals, and a member of the American Bar Association, Association of Business Trial Lawyers, the State Bar of California, and the Bar Association of San Francisco. He has served as co-chair for the Section of Real Property and Business Law for the Santa Clara County Bar Association and is a member of The International Council for Online Dispute Resolution and California Arbitration. He has also been a liaison for the Litigation Section of the State and Local Bar Association, served on the Standing Committee for Continuing Legal Education with the ABA, and chaired the Litigation Section’s Corporate Council Committee, leading it for three years. Additionally, he is a parishioner at St. Raymond Catholic Church and volunteers as a mediator for the Santa Clara County Bar Association, the Santa Clara County Superior Court, and the United States District Court.
In light of his impressive undertakings, Mr. Burke was named to Best Lawyers in America for mediation, arbitration, and commercial litigation from 2007 to the present and has been recognized in Alternative Dispute Resolution by California Super Lawyers from 2007 to the present. He also holds an AV Preeminent Rating from Martindale-Hubbell. Laying a solid educational foundation, he earned a Bachelor of Arts in economics, magna cum laude, from Cornell University in 1972 and a Juris Doctor from Harvard Law School in 1975.
